1.1 Parties. This agreement is concluded between HNK Tech
("HNKTech", "we") and the natural or legal person using the application
("User", "you").
1.2 Subject. It governs the terms of use of the Çiftçi AI mobile and web
application and the rights and obligations of the parties.
1.3 Formation. The agreement is formed when you create an account and tick
the acceptance box. If you do not accept it, do not use the application.
1.4 Integral parts. The following form an inseparable part of this
agreement: Privacy Policy,
Personal Data Processing Notice,
Application — Çiftçi AI mobile and web software. Account — your
personal user record. Content — anything you upload or publish.
Marketplace — the classified-advert board inside the app. Pro — the
paid subscription tier. Store — Apple App Store or Google Play.
3.1 Age. The application is for users aged 18 and over. It is not
directed at minors. If we determine that an account belongs to a minor, we
close it.
3.2 Registration. You can register with a phone number (verified by SMS) or
with a Google account. You must complete onboarding and select a role once; the
role is then locked and can only be changed through support.
3.3 Verified roles. The "worker" role requires a national ID document, and
the "trader" role requires a tax/registration number, for verification.
Submitting a document does not by itself grant a verified badge; a human
reviews it.
3.4 Security. You are responsible for your account. Do not share your
verification code with anyone. HNKTech never asks for your code.
3.5 Closing. You may delete your account at any time from
Profile → Delete My Account.
You undertake to provide accurate information, to keep it up to date, to comply
with the law and the Community Guidelines, not to infringe the rights of
others, to use the application only for its intended purpose, and to be
truthful in adverts you publish.
5.1 Unlawful or objectionable content — obscenity, sexual content, hate
speech, incitement to violence, terrorist propaganda, sale of unlicensed
agricultural pesticides, prescription veterinary drugs, weapons or protected
species.
5.2 Harassment — insults, threats, stalking, doxxing, publishing another
person's national ID number, address, IBAN or phone number without consent.
5.3 Fraud and deception — fake adverts, payment redirection schemes,
advance-fee requests, pyramid schemes, misleading price or quality claims.
5.4 Impersonation — using another person's or organisation's identity,
falsely claiming to represent a public authority or HNKTech.
5.5 Automated access — scraping, bots, bulk data extraction, load attacks,
circumventing rate limits, creating multiple accounts to evade enforcement.
5.6 Reverse engineering — decompiling, modifying or redistributing the
application, removing security measures.
5.7 Misuse of AI services — attempting to extract system prompts, using the
service to generate unlawful content, deliberately exhausting quota.
6.1 Our commitment. HNKTech applies zero tolerance to objectionable
content and abusive behaviour. Content that violates the rules is removed and
the responsible account is restricted or terminated.
6.2 Reporting. Every post, message and advert has a "…" menu with
Report and Block user. Reports are reviewed **within 24 hours at the
latest**. Content is also screened by an automatic filter before publication.
6.3 Enforcement. In escalating order: the content is not published · the
content is removed · a written warning · temporary suspension · indefinite
suspension · account termination. Severity and repetition determine the step.
Serious violations (threats to life, child safety, terrorist propaganda) lead
directly to termination and, where appropriate, notification to law enforcement.
6.4 Appeal. You may appeal any decision to [email protected] within
30 days. Appeals are reviewed by a human.
6.5 Limits. Moderation does not make HNKTech the author of user content and
does not create an obligation of prior review of every item.
7.1 Content you create remains yours.
7.2 By publishing content in the application you grant HNKTech a
non-exclusive, royalty-free, worldwide licence to store, display, reproduce and
transmit it solely for the purpose of operating the service.
7.3 Not covered by the licence: selling your content to third parties,
using it in advertising, transferring it to another platform.
7.4 AI training. Your content is not used to train AI models. Text and
images sent to AI providers are used only to produce your answer.
7.5 Your warranty. You warrant that you hold the rights to the content you
publish and that it does not infringe third-party rights.
7.6 Feedback. Suggestions you send through the feedback channel may be used
without restriction and without payment.
8.1 HNKTech operates a notice board. It publishes adverts and enables
the parties to contact each other. It does not sell, buy, take payment,
charge commission, hold funds in escrow, inspect goods or arrange delivery.
8.2 Any sales contract is concluded between the buyer and the seller.
HNKTech is not a party to it.
8.3 There is no payment inside the application for marketplace items.
Anyone asking you to pay "through the app" is attempting fraud — report it.
8.4 Safe trading: meet in person where possible, inspect the goods, prefer
recorded payment methods, be sceptical of unusually low prices, do not send an
advance payment before seeing the goods.
9.1 All AI output is informational. It does not replace an agricultural
engineer, a veterinarian or the Ministry of Agriculture and Forestry.
9.2 Models can be wrong or produce plausible-sounding but incorrect output.
The stated confidence percentage is an estimate, not a guarantee.
9.3 Decisions about pesticide dosage, quarantine and pre-harvest intervals
are yours; always check the product label and official sources.
9.4 HNKTech is not liable for loss arising from reliance on AI output. See
10.1 Pro is a monthly, automatically renewing subscription sold **through
the Store** as an in-app purchase. The price is ücretsiz (bu sürümde ücretli üyelik bulunmamaktadır) including
VAT. HNKTech never sees or stores your card details.
10.2 Cancellation. Cancel from your Store account settings at least 24
hours before the end of the current period. Uninstalling the app does not
cancel the subscription.
10.3 Refunds are handled by the Store under its own policy.
10.4 Right of withdrawal. Under Article 15/1-(ğ) of the Distance Contracts
Regulation there is no right of withdrawal for services performed
instantaneously in electronic form. Store refund policies still apply. See
10.5 Price and feature changes are announced at least 30 days in advance
and apply from the next renewal.
10.6 Core features remain usable without a subscription, within free-tier
limits.
11.1 The application, its source code, design, brand and databases belong
to HNKTech.
11.2 You are granted a personal, non-transferable, revocable licence to use
the application.
11.3 Third-party components (map tiles, satellite imagery, weather data, AI
providers) remain subject to their own licences.
12.1 You may terminate at any time by deleting your account.
12.2 HNKTech may suspend or terminate your account in the event of a
material breach, fraud, a risk to the security of the service or a legal
obligation. Except in urgent cases you are notified with reasons.
12.3 On termination your right to use the service ends; data handling
follows the Privacy Policy and the Account Deletion page.
12.4 HNKTech may modify or discontinue the service, announcing this at
least 30 days in advance where reasonably possible.
13.1 The service is provided "as is". Uninterrupted or error-free operation
is not warranted.
13.2 HNKTech is not liable for: the accuracy of AI output; the accuracy
or timeliness of satellite, weather and fire data; disputes between marketplace
users; the conduct of other users; loss caused by third-party services;
crop loss, yield loss or animal loss arising from your farming decisions.
13.3 Where liability cannot lawfully be excluded, it is limited to the
amount you paid in the last 12 months. This limitation does not apply to
intent, gross negligence, or death or personal injury.
13.4 If a third party brings a claim because of your content, you agree to
indemnify HNKTech.
Neither party is liable for failure caused by events beyond its control,
including natural disaster, epidemic, war, general strike, nationwide internet
outage or actions of public authorities.
15.1 Turkish law applies.
15.2 Consumers may apply to the Consumer Arbitration Committee or the
Consumer Court at their place of residence, within the monetary limits updated
annually.
15.3 For non-consumers, the courts and enforcement offices of
Akyurt / Ankara, Türkiye have jurisdiction.
15.4 Please write to [email protected] before starting legal
proceedings; most disputes are resolved directly.
16.1 These terms may be updated. 16.2 Material changes are notified
in-app at least 7 days in advance. 16.3 If you do not accept the new
version you may delete your account; continued use constitutes acceptance.
16.4 Each version carries a number and date. 16.5 If a provision is
invalid, the remainder stays in force. 16.6 HNKTech may transfer this
agreement in the event of a merger or transfer of business.
17.1 Apple App Store. This agreement is between you and HNKTech, not Apple.
Apple has no obligation to provide maintenance or support. If the application
fails to conform to warranty, you may notify Apple and Apple may refund the
purchase price; beyond that Apple has no warranty obligation. Apple is not
responsible for product liability claims, third-party intellectual property
claims or consumer protection claims. Apple and its subsidiaries are
third-party beneficiaries of this agreement and may enforce it against you.
You represent that you are not located in a country subject to a U.S. embargo
and are not on any U.S. prohibited-parties list.
17.2 Google Play. Google Play Terms of Service apply in addition. Google is
not a party to this agreement.
